Software License Agreement

> License Grant

NoctaVPN grants you a limited, non-exclusive, non-transferable license to use the NoctaVPN software application (the "Software") in accordance with the terms and conditions set forth in this License Agreement.

This license is granted solely for your personal, non-commercial use of the Software. You may not sublicense, rent, lease, or otherwise transfer the Software to any third party.

> Restrictions

You may NOT:

• Copy, modify, or create derivative works of the Software
• Reverse engineer, decompile, or disassemble the Software
• Remove or alter any copyright, trademark, or proprietary notices
• Use the Software in any way that violates applicable laws
• Attempt to bypass security measures or access unauthorized features
• Share your license with others
• Use the Software for commercial purposes without written permission

> Open Source Components

The Software may include open source components licensed under various open source licenses. These components remain subject to their respective licenses.

> Subscription and License

Your license to use the Software is tied to your active subscription:

• License is valid while your subscription is active
• Upon subscription termination, your license expires
• We reserve the right to revoke your license for violations
• You may use the Software on devices specified in your subscription plan

> Updates and Modifications

NoctaVPN may provide updates, patches, or modifications to the Software. These updates may be:

• Automatically downloaded and installed
• Required for continued use of the service
• Subject to different terms than this license

Continued use of the Software after receiving updates constitutes acceptance of any new terms.

> Intellectual Property Rights

All intellectual property rights in the Software, including copyrights, trademarks, patents, trade secrets, and any other proprietary rights, remain the exclusive property of NoctaVPN and its licensors. This license does not grant you any rights to use NoctaVPN's trademarks, service marks, or logos.

> Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the maximum extent permitted by law, NoctaVPN disclaims all warranties, including:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Security, reliability, or accuracy

NoctaVPN does not warrant that the Software will meet your requirements or operate without interruption or errors.

> Limitation of Liability

To the maximum extent permitted by law, NoctaVPN shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Software.

In no event shall NoctaVPN's total liability exceed the amount you paid for the Software in the twelve months preceding the claim.

> Termination

This license is effective until terminated. Your license will automatically terminate if you:

• Fail to comply with any term of this agreement
• Cancel your subscription
• Violate our Terms of Service
• Uninstall or delete the Software

Upon termination, you must cease all use of the Software and delete all copies in your possession.

> Export Restrictions

You acknowledge that the Software may be subject to export and import restrictions. You agree to comply with all applicable export control laws and regulations. You will not export or re-export the Software to any prohibited country or to any prohibited person.

> Governing Law

This License Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where NoctaVPN is incorporated, without regard to conflict of law principles.

> Entire Agreement

This License Agreement, together with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and NoctaVPN regarding the Software. This agreement supersedes all prior understandings and agreements.
